1. 引言

Shadow Size 是一款基于人工智能的智能尺码推荐系统，专为电商商家设计。我们提供以下功能：

  • 智能尺码推荐引擎（支持参考品牌、测量数据、身高体重等多种推荐方法）
  • 商品管理和尺码表配置
  • 可嵌入的 Widget 组件，用于在您的店铺中显示尺码推荐
  • Shopify 平台集成
  • 推荐数据分析和报告

3. 用户账户

为了使用服务的某些功能，您需要注册账户并同意：

  • 提供准确、完整的商家信息。
  • 维护账户凭据的机密性。
  • 账户发生任何未经授权的使用时，立即通知我们。
  • 对您账户下的所有活动负责。

4. 用户责任

您对使用本服务输入、上传或生成的内容（"用户内容"）负责，并同意：

  • 上传准确的商品信息和尺码表数据。
  • 不上传违法、有害、侵权或欺诈性内容。
  • 不侵犯他人的知识产权或商标权。
  • 不将服务用于任何非法目的。
  • 不尝试反向工程或干扰服务运行。
  • 不滥用 API 接口或进行过度请求。

5. 知识产权

  • 我们的权利：我们拥有服务的所有权及相关利益，包括所有软件、设计、文本、图形、推荐算法和数据库（用户内容除外）。
  • 您的权利：您保留对您上传或生成的任何用户内容（如商品信息、尺码表）的所有权。通过使用服务，您授予我们非独家、全球性的许可，仅为了向您提供服务的目的而使用、显示和复制您的用户内容。

6. 订阅与积分政策

Shadow Size 采用订阅制 + 积分系统的商业模式：

6.1 订阅方案

我们提供不同的订阅方案（如基础版、专业版、企业版），具体功能和价格请参考官网定价页面。

6.2 积分系统

  • 每次尺码推荐会消耗一定数量的积分。
  • 不同订阅方案提供不同的月度积分额度。
  • 未使用的积分不会累积到下个月（除非您购买额外积分包）。
  • 积分不可转让、退款或兑换现金。

6.3 退款政策

由于 Shadow Size 提供的是非实物、不可撤销的数字产品及即时访问权限：

通常情况下，一旦订阅激活或积分购买完成，我们不予退款。 作为客户，您在购买任何订阅或积分前有责任知晓并理解这一点。

6.4 特殊情况

我们深知可能存在特殊情况。我们将视情况决定是否受理以下退款请求：

  • 技术问题：如果您遇到了持续性的技术故障，且我们在收到您的报告后 14 天内无法解决。
  • 计费错误：由于系统错误导致的意外重复计费。
  • 服务中断：如果服务连续中断超过 72 小时且无法恢复。

6.5 退款请求期限

任何退款请求必须在原始购买日期后的 14 天内 提交。超过此期限的请求将不予考虑。

6.6 订阅取消

您可以随时通过账户设置或 Lemon Squeezy 收据中的链接取消订阅：

  • 取消后将停止后续计费。
  • 在当前计费周期结束前，您可以继续使用所有功能。
  • 取消订阅不会导致剩余期限的按比例退款。
  • 取消后，您的数据和配置将保留，您可以继续访问账户，直到您主动删除账户。
  • 如果您删除账户，您的个人数据将在 30 天内删除（详见隐私政策）。

7. 第三方集成

Shadow Size 可以与第三方服务集成（如 Shopify）。使用这些集成时：

  • 您需要遵守第三方服务的条款和政策。
  • 我们不对第三方服务的可用性、准确性或可靠性负责。
  • 您授权我们访问和使用必要的第三方数据以提供服务。
  • 您可以随时断开第三方集成。

8. 服务可用性

我们努力保持服务的高可用性，但不保证服务不会中断。我们可能会：

  • 定期进行系统维护和升级。
  • 在紧急情况下暂停服务。
  • 随时修改或停止某些功能。

我们将尽力提前通知重大变更，但不保证总是能够做到。

9. 终止

终止后：

  • 对适销性、特定用途的适用性和非侵权性的暗示保证。
  • 尺码推荐的准确性和可靠性（推荐结果仅供参考）。
  • 服务的持续可用性或无错误。

重要：尺码推荐结果基于算法和提供的数据生成，仅供参考。我们不对因推荐错误导致的退换货、客户投诉或任何损失负责。

11. 责任限制

在任何情况下，Shadow Size 均不对因您使用服务而导致的任何间接、偶然、特别、后果性或惩罚性损害负责，包括但不限于：

  • 利润损失、数据丢失、业务中断。
  • 客户投诉、退换货成本。
  • 商誉损失或其他无形损失。

我们的总责任不超过您在过去 12 个月内支付给我们的金额。

12. 条款变更

我们可能会随时修改本条款。重大变更将通过在本页面发布新条款来通知您。您在变更后继续使用服务即表示接受新条款。

13. 适用法律与争议解决

本条款受中华人民共和国法律管辖。任何争议应首先通过友好协商解决。如果协商不成，争议应提交至 深圳市南山区 有管辖权的法院。

14. 保密条款

双方同意对在使用服务过程中获知的对方保密信息予以保密。保密信息包括但不限于商业计划、技术数据、客户信息、定价策略等。未经对方书面同意，不得向第三方披露保密信息。本条款在账户终止后仍然有效。

15. 其他条款

  • 完整协议：本条款构成您与我们之间的完整协议。
  • 可分割性：如果本条款的任何条款被认定为无效，其余条款仍然有效。
  • 弃权：我们未能执行本条款的任何权利不构成对该权利的放弃。

1. Introduction

Welcome to Shadow Size ("we," "our," or "us"). By accessing or using our website, application, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Shadow Size is an AI-powered intelligent size recommendation system designed for e-commerce merchants. We provide the following features:

  • Intelligent size recommendation engine (supporting multiple methods such as reference brands, body measurements, height/weight)
  • Product management and size chart configuration
  • Embeddable Widget component for displaying size recommendations in your store
  • Shopify platform integration
  • Recommendation data analysis and reporting

3. User Accounts

To access certain features of the Service, you are required to register for an account. You agree to:

  • Provide accurate and complete merchant information.
  • Maintain the confidentiality of your account credentials.
  • Notify us immediately of any unauthorized use of your account.
  • Be responsible for all activities under your account.

4. User Responsibilities

You are responsible for the content you input, upload, or generate using our Service ("User Content"). You agree not to:

  • Upload inaccurate product information or size chart data.
  • Upload content that is illegal, harmful, infringing, or fraudulent.
  • Infringe upon the intellectual property or trademark rights of others.
  • Use the Service for any unlawful purpose.
  • Attempt to reverse engineer or disrupt the Service.
  • Abuse API interfaces or make excessive requests.

5. Intellectual Property

  • Our Rights: We own all rights, title, and interest in and to the Service, including all software, design, text, graphics, recommendation algorithms, and databases (excluding User Content).
  • Your Rights: You retain ownership of any User Content you upload or generate (such as product information and size charts). By using the Service, you grant us a non-exclusive, worldwide license to use, display, and reproduce your User Content solely for the purpose of providing the Service to you.

6. Subscription & Credits Policy

Shadow Size operates on a subscription + credits business model:

6.1 Subscription Plans

We offer different subscription plans (such as Basic, Pro, Enterprise). For specific features and pricing, please refer to our official pricing page.

6.2 Credits System

  • Each size recommendation consumes a certain number of credits.
  • Different subscription plans provide different monthly credit allocations.
  • Unused credits do not roll over to the next month (unless you purchase additional credit packs).
  • Credits are non-transferable, non-refundable, and cannot be exchanged for cash.

6.3 Refund Policy

Because Shadow Size provides non-tangible, irrevocable digital goods and instant access to features:

We generally do NOT issue refunds once a subscription is activated or credits are purchased. As a customer, you are responsible for understanding this upon purchasing any subscription or credits at our site.

6.4 Exceptional Circumstances

We understand that exceptional circumstances can take place. We may, at our sole discretion, honor requests for a refund in the following cases:

  • Technical Issues: If you experience permanent technical problems with the service that we are unable to resolve within 14 days of your report.
  • Billing Errors: If you were accidentally double-billed due to a system error.
  • Service Outage: If the service is continuously interrupted for more than 72 hours and cannot be restored.

6.5 Refund Request Window

Any request for a refund must be submitted within 14 days of the original purchase date. Requests made after this period will not be considered.

6.6 Subscription Cancellation

You may cancel your subscription at any time through your account settings or via the link provided in your Lemon Squeezy receipt:

  • Cancellation stops future billing.
  • You will continue to have access to all features until the end of your current billing cycle.
  • Cancellations do not entitle you to a prorated refund for the remaining period.
  • After cancellation, your data and configuration will be retained, and you can continue to access your account until you voluntarily delete it.
  • If you delete your account, your personal data will be deleted within 30 days (see Privacy Policy).

7. Third-Party Integrations

Shadow Size can integrate with third-party services (such as Shopify). When using these integrations:

  • You must comply with the terms and policies of the third-party service.
  • We are not responsible for the availability, accuracy, or reliability of third-party services.
  • You authorize us to access and use necessary third-party data to provide the Service.
  • You may disconnect third-party integrations at any time.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted service. We may:

  • Conduct periodic system maintenance and upgrades.
  • Suspend service in emergency situations.
  • Modify or discontinue certain features at any time.

We will make reasonable efforts to notify you of significant changes in advance but cannot guarantee that we will always be able to do so.

9. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties.

Upon termination:

  • You will immediately lose access to your account and data.
  • We will delete or retain your personal information as required by law (see Privacy Policy).
  • Any fees paid are non-refundable.

Note: Termination is different from subscription cancellation. Subscription cancellation is your voluntary choice, while termination is an action we take due to policy violations.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to:

  • The implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • The accuracy and reliability of size recommendations (recommendations are for reference only).
  • The continuous availability or error-free operation of the Service.

Important: Size recommendation results are generated based on algorithms and provided data and are for reference only. We are not responsible for returns, customer complaints, or any losses resulting from recommendation errors.

11. Limitation of Liability

In no event shall Shadow Size be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, data, or business interruption.
  • Customer complaints or return costs.
  • Loss of goodwill or other intangible losses.

Our total liability shall not exceed the amount you paid us in the past 12 months.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of any significant changes by posting the new Terms on this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the People's Republic of China. Any disputes shall first be resolved through friendly negotiation. If negotiation fails, disputes shall be submitted to the competent court in Nanshan District, Shenzhen.

14. Confidentiality

Both parties agree to keep confidential any confidential information obtained from the other party during the use of the Service. Confidential information includes but is not limited to business plans, technical data, customer information, pricing strategies, etc. Neither party shall disclose confidential information to third parties without written consent from the other party. This clause remains effective after account termination.

15. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and us.
  • Severability: If any provision of these Terms is found to be invalid, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
